  1. Preamble:

    This privacy notice for the Institute of Health Systems (IHS) and the IHS Laboratory, describes how and why we might collect, store, use, and/or share (“process”) your information when you use the Nagar Jal Suraksha (NJS) app and its connected database.

    Reading this privacy notice will help you understand your privacy rights and choices. If you do not agree with our policies and practices, please do not use this app.

  2. Definitions:
    1. "Account" means a unique account created for You to connect with NJS Central Database, access and update data dictionaries, and synchronise or upload water quality monitoring data gathered by you using your device and the NJS app.
    2. "Application" “App” or “app” means the NJS Android app developed by IHS and downloaded by You on any electronic device.
    3. "Country" refers to India.
    4. "Cookies" are small files that are placed on Your device by a website, containing the details of Your browsing history on that website among its many uses.
    5. "Device" means any device such as a computer, a cell phone or a digital tablet that can access the NJS central database.
    6. IHS Laboratory means the Institute of Health Systems Laboratory.
    7. IHS means the Institute of Health Systems and includes the IHS Laboratory.
    8. IHS is the Water Quality Monitoring Agency for purposes of the NJS App.
    9. "Institute" (referred to as either "the Institute", "We", "Us" or "Our" in this Agreement) refers to the IHS.
    10. NJS app means the Nagar Jal Suraksha Android app developed the IHS.
    11. NJS Central Database is online database to which Your NJS app is programmed to connect at the time of installation and whenever you choose ‘Online Dictionary Tables’ as the Work Mode.
    12. "Personal Data" is any information that relates to an identified or identifiable individual.
    13. "Service" refers to the NJS Central Database.
    14. "Service Provider" means any natural or legal person who processes the data on behalf of the Institute. It refers to third-party companies or individuals employed by the Institute to facilitate the Service, to provide the Service on behalf of the Institute, to perform services related to the Service or to assist the Institute in analyzing how the Service is used.
    15. "Usage Data" refers to data collected automatically, either generated by the use of the NJS app or from the NJS central database.
    16. Water Quality Monitoring (WQM) means distribution system & consumer-end water quality monitoring programs and/or activities including on-the-spot field testing and sample collection from all over the distribution network culminating at the consumer-end as well as laboratory testing, sanitary inspections and community connect for water safety.
    17. Water Quality Monitoring Agency (WQM-Agency) means the organisational entity that coordinates some or all water quality monitoring activities in a given area. WQM-Agency, would include the concerned water utility, any agency commissioned by the concerned water utility, and/or an independent agency that has a program of monitoring distribution system and consumer-end water quality.
    18. Water Quality Investigator (WQI) means any person engaged by the Water Quality Monitoring Agency, by whatever designation, to participate in Water Quality Monitoring activities. WQIs include Water Quality Investigators, Apprentices & Interns in the field of Water Quality Monitoring and Water Safety activities, Water Safety Surveyors, Water Quality Monitoring Volunteers, and such others.
    19. “Water Utility” means the appropriate department, organisation or authority of the concerned local body, municipal or metropolitan for water supply and related services.
    20. "You" means the individual accessing or using the NJS app.
  3. Who can use the NJS App?
    1. WQIs formally engaged by the Water Quality Monitoring Agency to participate in the WQM program can use the NJS App. Thus, you must first have a formal affiliation with the IHS for WQM activities, in order to use the NJS App.
  4. What data do we collect?
    1. Collection of Personal Data: The NJS App uses a limited subset of personal information provided by you to the WQM Agency for participation in WQM program. In particular, the NJS Central Database may store the following personal data of WQIs.
      1. Name
      2. Short Name assigned by the WQM Agency for display in the NJS App.
      3. Mobile Number and alternate mobile number, if any.
      4. Email address and alternate email address, if any.
      5. Educational qualifications, training and skill development credentials for WQM activities.
      6. Your photograph image file provided by you.
      7. Reference number and date of your authorization to act as a water quality investigator.
      8. Authorised Channel(s) or Programme(s) of water quality monitoring activity.
      9. Period of validity of your authorization to act as a water quality investigator.
      10. The water utility operation & maintenance division(s), units and areas assigned to you, from time to time.
      11. Authorised devices to be used by you for recording of field testing and sample collection data using the NJS app.
      12. Any other identifying information required by the WQM agency and voluntarily provided by you.
    2. Account Access Data: The NJS central database may store your account access data such as;
      1. Your User Id,
      2. Your Password, and
      3. Access and usage data: The NJS Central Database server may automatically collect and record service-related, diagnostic, usage and performance information when you access or use the NJS Central Database. This log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called “crash dumps”), and hardware settings).
    3. Collection of Application Data:
      1. When you save or append any record of WQM activity using the App it gathers geo location data, identification of the device in which the app is running, system data and time, and photographs, if any, taken by you.
      2. We gather location-based information from your mobile device, while you are using the NJS app for recording of field testing and sample collection information.
      3. Mobile Device Access. We may request access or permission to certain features from your mobile device, including your camera, own, and other features.
    4. Collection of Device Data:
      1. When you are using the NJS app, we may automatically collect device information (such as your device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server) at the time of installation or update.
      2. We automatically collect certain device related information when you connect to the NJS central database. This information may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you connect. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
    5. Sensitive Personal Data: The NJS App and the NJS Central Database does not collect any sensitive personal data. In particular, the NJS app and central database;
      1. Does not collect any financial data.
      2. Does not collect any personal health information.
      3. Does not collect any credential data such as username, password, personal identification number (PIN) to access any system, application, or service, except the NJS App and the NJS Central Database.
    6. Cookies & Tracking Technology: We do not collect information through cookies. The NJS app does not install any cookie or such other tracking application in your device. Access to NJS central database does not involve installation of any cookie or such other tracking application in your device.
  5. How do we process and use NJS data?
    1. Processing and Use of Personal Data:
      1. The personal data listed at D.1 above are used internally for program management, performance review, data validation, error correction and to facilitate account creation and authentication.
      2. We may process your information so you can create and log in to your account, as well as keep your account in working order.
      3. We may process your information to respond to your inquiries and solve any potential issues about use of the NJS app and access to NJS central database.
      4. We may process your information to send WQM program related information to you.
    2. Transfer of Your Personal Data:
      1. We may share your personal data with the concerned Water Utility to facilitate access to water supply and distribution system for WQM purposes.
      2. We do not share your personal data with any agency or entity unconnected with the WQM program in which you participate.
      3. We do not share your personal data with any advertiser.
    3. In some exceptional cases, we may be legally permitted or obliged under applicable law to process your information without your consent, including, for example:
      1. For investigations and fraud detection and prevention.
      2. For identifying injured, ill, or deceased persons and communicating with next of kin.
      3. If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse.
      4. If disclosure is required to comply with a summons, warrant, court order, or rules of the court relating to the production of records.
      5. If the collection is solely for journalistic, artistic, or literary purposes.
      6. If the information is publicly available and is specified by the regulations.
    4. Retention of Your Personal Data:
      1. We will retain Your Personal Data only for as long as is necessary for the WQM project, for research and analysis purposes.
      2. We retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.
    5. Processing and Use of Application Data:
      1. Note that, the data produced by You using the NJS app is in the course of your participation in WQM program. Accordingly, WQM related data gathered by you through the NJS app will be used along with relevant data from other sources to improve water safety and for effective WQM program management purposes.
      2. Application data is processed and analysed, to assess the overall status, identify vulnerabilities, and need for systemic improvements in water supply distribution system.
      3. A single or collection of records filtered by appropriate criteria may be shared with concerned water utility for policy formulation, remedial actions, development works and/or training purposes as and when necessary.
      4. Application data may be retained for study and analysis of long-term patterns and factors affecting water safety, scope for improvement of WQM programs and water safety.

    6. Processing and Use of Account Access Data:
      1. We use account access to ensure authorised and secure access to the NJS central database.
      2. We do not share your account access data to any third party.
    7. Sensitive Personal Information: The NJS app and the NJS Central Database do not collect ad do not process any sensitive personal information.
    8. Cookies: We do not install any cooky in your device and do not gather any data by use of cookies.
    9. Push Notifications and Advertisement: We do not send any push notifications or advertisements to users of NJS app.
